On February 5, 2018, the Supreme Court granted leave to appeal in a case where LA PARTNERS through the lawyer Patrik Svensson and the jur. kand. Max Olsson represents the complainant (HD’s case no. T 1523-17). The case mainly concerns the question of how the Real Estate Development Act’s rules on land transfer relate to property protection in the form of government and the European Convention. The question is in fact of great legal and practical importance in the National Land Survey’s daily work, but also touches from a larger perspective on how central concepts in the assessment of property protection are to be interpreted and applied.
LA PARTNERS has previously in a plenary decision in the Supreme Court successfully tried the question of the individual’s right, according to the constitutionally protected right to a fair trial, to be reimbursed for his legal costs in cases against the state where a foreclosure has been revoked (NJA 2017 p. 374) .
